MUMBAI: Merely moving hand over the back and head of a minor girl without any sexual intent does not amount to outraging her modesty, the Nagpur bench of the Bombay High Court remarked while quashing the conviction of a 28-year old man.
The case dates back to 2012 when the convict, then 18 years old, was booked on charges of outraging the modesty of a 12-year-old girl. According to the victim, the accused had moved his hand on her back and head and commented that she had grown up.

New Delhi: The Supreme Court on Wednesday stayed the Bombay high court order which acquitted a man under the Protection of Children from Sexual Offences (POCSO) Act saying groping a minor’s breast without “skin-to-skin contact” cannot be termed as sexual assault.
A bench of Chief Justice of India S.A. Bobde and Justices A.S. Bopanna and V. Ramasubramanian stayed the high court order after Attorney General K.K. Venugopal mentioned the matter. According to news reports, he submitted that the judgement was “unprecedented” and “is likely to set a dangerous precedent”.

Upholding the clean chit given to a former CRRI scientist with regard to a complaint of an ex-colleague against him, the HC said there should be context while defining a physical contact as sexual in nature. NEW DELHI: While acquitting a rape accused recently, a court commented that no one discusses the “dignity and honour” of men, given that everyone is fighting for the rights, honour and dignity of women. Besides, it said, laws meant to protect women might be misused by women.
