This decision is expected to benefit every year nearly 1500 OBC students in MBBS and 2500 OBC students in postgraduation and also around 550 EWS students in MBBS and around 1000 EWS students in postgraduation.
The Narendra Modi-led government has approved reservations for OBC and EWS (economically weaker Section) students in All India Quota for medical admissions. Now, for admission to both graduate (MBBS, BDS), postgraduate and diploma level medical courses students hailing from other backward class categories (OBC) will get 27%, and those from the Economically Weaker Section (EWS) will get 10% reservation. The Madhya Pradesh High Court has upheld an interim stay on OBC reservation above 14 per cent. On the other hand, by filing an application on behalf of the state government, permission has been sought for appointment in the undisputed quota in the National Rural Health Mission.
The Division Bench of Chief Justice (Acting) Sanjay Yadav and Justice Vijay Kumar Shukla have sought a reply from the petitioner on the state government’s application. The next hearing of the case has been scheduled for January 4. Read more ...

SUB-CATEGORISATION IN SC/ST AND OBC QUOTA OKAYED BY HON’BLE SUPREME COURT

Sub-Categorisation in the SC/ST and OBC quota has been okayed by Hon’ble Supreme Court vide its judgment dated 27.08.2020 in the case of The State of Punjab & Ors. Vs. Davinder Singh & Ors. However, a final decision in this regard will be taken by the 7-Judges bench, to be constituted by the Chief Justice of India. It has been held by Hon’ble Supreme Court as under:-
PARAS 50-52
“50. The “inadequate representation” is the fulcrum of the provisions of Article 16(4). In our opinion, it would be open to the State to provide on a rational basis the preferential treatment by fixing reasonable quota out of reserved seats to ensure adequate representation in services. Reservation is a very effective tool for emancipation of the oppressed class. The benefit by and large is not percolating down to the neediest and poorest of the poor.
51. The interpretation of Articles 14, 15, 16, 338, 341, 342, and 342A is a matter of immense public importance, and correct interpretation of binding precedents in Indra Sawhney and other decisions. Though we have full respect for the principle of stare decisis, at the same time, the Court cannot be a silent spectator and shut eyes to stark realities. The constitutional goal of social transformation cannot be achieved without taking into account changing social realities.
52. We endorse the opinion of a Bench of 3 Judges that E.V. Chinnaiah is required to be revisited by a larger Bench; more so, in view of further development and the amendment of the Constitution, which have taken place. We cannot revisit E.V. Chinnaiah being Bench of coordinate strength. We request the Hon’ble Chief Justice to place the matters before a Bench comprising of 7 Judges or more as considered appropriate.”

Data: OBCs just 12% of lower court judges

NEW DELHI: The representation of OBCs or other backward classes in the subordinate judiciary of 11 states that responded to the Centre’s request for details adds up to just 12%, considerably lower than the estimates of the community’s share in India’s population.
Data received by the law ministry showed that Dalits comprised less than 14% of judges in the subordinate judiciary, including district courts, and tribals about 12%. The percentage for Dalits was under their share of the population, which stands at 16.6% according to the 2011 census. Tribal representation is a little higher than the 8.6% of India’s population they account for. …

As mentioned in the Ministry of Home Affairs letter dated 19.05.2021, that Ministry has already issued advisories to the States/Union Territories on the Guidelines and Standard Operating Procedures for preventing and combating crimes against vulnerable sections of the society, including –

(i) women,
(ii) children,
(iii) senior citizens, and
(iv) scheduled castes/ scheduled tribes,

and as well as for putting in place institutional mechanisms for preventing and countering human trafficking. The Government had launched several initiatives for the safety and security of women, which include implementation of Emergency Response Support System, establishing National Database on Sexual Offenders to facilitate better investigation etc. Several laws for combating crimes against weaker sections have also been enacted/ strengthened such as –  

(i) the Protection of Women from Domestic Violence Act, 2005;
(ii) the Indecent Representation of Women (Prohibition) Act, 1986;
(iii) the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013,
(iv) the Juvenile Justice (Care and Protection of Children) Act, 2015,
(v) the Protection of Child Rights Act, 2005,
(vi) the Protection of Children from Sexual Offences Act, 2012, amended in 2019, and
(vii) the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (amended in 2015 and 2018).

The States/Union Territories have been further enabled through provision of several IT modules by the National Crime Records Bureau (NCRB) in this area, including the Crime Multi Agency Centre (Cri-MAC) for police to share information of inter-state relevance, and a National Alert Service for police on missing & found persons using the CCTNS. The NCRB has also launched an automated photo matching web-based application UNIFY that uses Machine learning model to enable police personnel to search the photographs of missing persons/ criminals/unidentified dead bodies against the national image repository in the CCTNS. A central citizen service on digitalpolicecitizenservice.gov.in portal is now available to citizens for online search on missing persons. Further, the Ministry has also circulated guidelines and SOP for supporting senior citizens during COVID-19. The guidelines provides for steps to be taken to ensure necessary monitoring and support to senior citizens.

The Ministry of Home Affairs has requested all State Governments/UT Administrations to undertake an immediate review of the existing facilities for vulnerable groups inter-alia on the lines of the measures given in the various advisories issued by the MHA, especially for –

(i) children who have been orphaned,
(ii) senior citizens who may require timely assistance and support (medical as well as safety & security), and
(iii) members of scheduled castes/scheduled tribes who may need guidance to access Government support facilities.

The review may include steps taken for sensitization of police personnel, coordination with agencies/departments concerned as also communities and civil society organizations.

For recovery of excess/wrong pension disbursed to pensioners, banks to seek guidance from the Pension Sanctioning Authority

Vide Reserve Bank of India’s Circular dated 21 January, 2021, the agency banks have been requested to seek guidance from respective Pension Sanctioning Authorities regarding the process to be followed for recovery of excess pension paid to the pensioners, if any.
The agency banks have been advised by the Reserve Bank of India that where excess pension payment has arisen on account of mistakes committed by the bank, the amount paid in excess should be refunded to the Government in lump sum immediately after detection of the same and without waiting for recovery of any amount from the pensioners.

All central government employees are entitled to receive pension on their retirement. However, they should know what they are entitled to so as to ensure no glitch deprives them of any aspect, especially regarding pension. Generally, pension is given even to those employees who have come across major injuries. However, the eligibility criteria is that, a central government employee is allowed pension after she or he puts in service of 10 years and more. A retiring pension is granted to a Government servant who is permitted to retire after completing qualifying service of 25 years. Currently, in India, pension is calculated at 50% of emoluments (last pay) or average emoluments (for last 10 months), whichever is more beneficial to the central government employees. However, there are certain rules and regulations in regards to how one should manage their pension account. Digital Certificate for Pensioners

Under the “Digital India Mission” Government of India has launched a Jeevan Pramaan application on 10.11.2014. the facility provides an option to a pensioner to give his life certificate remotely through the Jeevan Pramaan portal (https://jeevanpramaan.gov.in/). Aadhaar Number is used for authentication of pensioners. As a result of this facility the pensioner is not required to present himself before his pension disbursing agency or produce other documents that he is alive. Instructions related to submission and acceptance of ‘Jeevan Pramaan’ as additional mode for submission of life certificate have been issued to all the stakeholders by Controller General of Accounts. The Pension disbursing banks have been directed to implement the new life certification system immediately as an additional mode for submission of life certificate. This was stated by Shri Arun Jaitley, Finance Minister in written reply to a question in the Lok Sabha today. (Source: pib press release)

    The bench struck down the Maharashtra SEBC Act 2018 to the extent it held Marathas as a socially and economically backward class as violating the principles of equality. The bench struck down the reservation given to Marathas in job and education. However, the bench clarified that the judgment will not affect the PG Medical Admissions under Maratha quota made till 09.09.2020.
    The bench held that there was no need to revisit the 50% ceiling limit on reservation laid down by the 9-judge bench decision in the Indira Sawhney case.
    In a significant judgment, the Supreme Court has held by 3:2 majority that the 102nd Constitution Amendment has abrogated the power of states to identify “Socially and Educationally Backward Classes(SEBCs)”. Document Identification Number (DIN): In order to protect GST taxpayers from any harassment at the hands of errant tax officials, the Central Board of Excise and Customs (CBEC), is going to use a unique number in every communication with taxpayers from Friday. Initially, the department will use this unique document identification number (DIN) mostly for investigation related communications such as arrest warrants and search authorizations and it will be later expanded to cover all the communication issued by the officers of the board. All the communication issued on or after November 8 without a computer-generated document identification number will be invalid and deemed to have never been issued, said the CBIC in a letter issued to all the top officers on Tuesday. …

The government on Tuesday announced rules regarding MRP or maximum retail price for goods under the GST (goods and services tax) regime that was rolled out at the midnight of Friday and Saturday. There has been ample confusion among both consumers and retailers regarding how the MRP changes will reflect under GST.
“Under the GST regime, if a price of a product has increased the manufacturer/ importer/ packer will have to give an advertisement in two newspapers about the new MRP and put a revised sticker on the packaging,”, Department of Consumer Affairs Secretary Avinash Srivastava said. MUMBAI: The government and banks have scotched rumours that payments by credit cards or other electronic modes of payment would lead to double taxation under the newly-launched Goods and Services Tax.
Revenue secretary Hasmukh Adhia clarified by way of a tweet that “A wrong message is doing rounds on social media that if you make payment of utility bills by credit cards, you will be paying GST twice. The right of an adult couple to live together can’t be denied just because the man has not yet attained the marriageable age, the Punjab and Haryana high court has ruled.
The bench of Justice Alka Sarin observed that the couple being adult has every right to live their lives as they desire within the boundaries of the law.
“The society cannot determine how an individual should live her or his life. The Constitution guarantees every individual the right to life. The freedom to choose one’s partner is an important facet of the right to life. In the present case, the girl’s parents cannot dictate how and with whom she should spend her life since she is adult. Parents cannot compel a child to live life on their terms,” the bench said.
