The Rajasthan High Court on Friday struck down five per cent reservation for Gujjars and four other castes under the Special Backwards Classes (SBC) category, underlining that reservation should not be provided “to achieve political goals”.
“Five castes (Gujjars, Banjaras, Gadarias, Raikas and Gadia Lohars), earlier falling in the category of OBCs and getting benefit of reservation, have been brought in the category of SBCs to provide five per cent reservation exceeding the ceiling of 50 per cent,” the court said. “…it is not that the Gujjars/Gurjars and others were having no representation either for admission in the educational institutions or in services.’’ …

Cabinet approves inclusion/amendments in the Central List of Other Backward Classes notified in respect of 8 States

“The Union Cabinet chaired by the Prime Minister Shri Narendra Modi has given its approval to notify inclusion/Amendments in the Central List of Other Backward Classes notified in respect of States of Assam, Bihar, Himachal Pradesh, Jharkhand, Maharashtra, Madhya Pradesh, Jammu & Kashmir and Uttarakhand.
On the recommendation of the National Commission for Backward Classes (NCBC), a total of 2479 Entries for inclusion, including its synonyms, sub-castes, etc. in the Central List of Other Backward Classes have been notified in 25 States and 6 Union Territories. The last such notification was issued till September, 2016. Meanwhile more advices for inclusion of castes/communities and corrections in the existing list of OBCs for the State of Assam, Bihar, Himachal Pradesh, Jharkhand, Maharashtra, Madhya Pradesh, Jammu & Kashmir and Uttarakhand have been received from NCBC. Accordingly, a total of 28 changes recommended by NCBC in respect of 8 states including Jammu and Kashmir (15 new entries, 09 synonyms/sub-castes and 04 corrections) have been notified.
The changes will enable the persons belonging to these castes/ communities to avail the benefits of reservation in Government services and posts as well as in Central Educational Institutions as per the existing policy. They will also become eligible for benefit under the various welfare schemes, scholarships etc. being administered by the Central Government, which are at present available to the persons belonging to the Other Backward Classes.
Background
The NCBC was set up in pursuance to the Supreme Court judgement in the Indra Sawhney case as per the NCBC Act 1993. Section 9 (“Functions of the Commission”) of the NCBC Act 1993 states as under:
(i) The Commission shall examine requests for inclusion of any class of citizens as a backward class in the lists and hear complaints of over-inclusion or under-inclusion of any backward class in such lists and tender such advice to the Central Government as it deems appropriate.
(ii) The advice of the Commission shall ordinarily be binding upon the Central Government.”

MUMBAI: In one of the highest payouts in recent months, a Motor Accidents Claims Tribunal has ordered an insurance company and a truck owner to pay Rs 1 crore to the widower of a 26-year-old business development Carlsberg executive who died after her scooter was run over by a truck below the Andheri flyover in 2008.
Making no distinction between sexes in financial dependency by a spouse, the tribunal found the widower, now 37, was unemployed at the time of the incident and dependent on his wife. The tribunal said he deserved compensation under such circumstances. Vivek Satam, the complainant from Tardeo, had filed the complaint in April 2011. …

KANPUR: A college student arrested last year for the alleged murder of an 11-year-old boy has managed to prove his innocence and get acquitted with the help of Google. Jai Pratap Singh, alias Mohit, was let off on Thursday by additional district and sessions judge Rajat Singh Jain, who also observed that the role of police in the case was suspicious.

AHMEDABAD: Gujarat high court has observed that the lower courts should not pass any order without assigning proper and adequate reasons for arriving at a particular conclusion.
In one such “cryptic” order passed by the Motor Accident Claims Tribunal (MACT), Junagadh, the high court noticed, “It is a settled proposition of law that the courts are required to support their orders with cogent reasons as it introduces clarity in an order. Appropriate brief reasons, though not like a judgement are a necessary concomitant for a valid order.” …

CHENNAI: A consumer redressal forum has, in a rare instance, pulled up the Insurance Regulatory Development Authority (IRDA), the autonomous statutory body that regulates India’s insurance industry, asking the regulator and an insurance firm to pay compensation to a senior citizen for not taking appropriate action on a complaint he had filed.

NEW DELHI: The Supreme Court has ruled that insurance claims cannot be denied to a person merely on the grounds of delay in filing the claim, holding that “mechanical” denials on technical bases will cause people to lose confidence in the industry.
A bench of Justice R K Agrawal and Justice S Abdul Nazeer set aside the verdicts of various consumer courts, including the National Consumer Disputes Redressal Commission (NCDRC), which had ruled that insurance companies could deny the benefit of cover for delay in filing the claims …

NEW DELHI: The Supreme Court has ruled that a forcible entry is required for a claim to be  allowed  under  the  policy  for  burglary/house breaking.
Citing a 2004 SC judgment, Justice Rao said, “In the absence of violence or force, the insured cannot claim indemnification against the insurance company. The terms of the policy have to be construed as it is and we cannot add or subtract something. Howsoever liberally we may construe the policy, we cannot take liberalism to the extent of substituting the words which are not intended. “…in common parlance, the term ‘burglary’ would mean theft but it has to be preceded with force or violence. If the element of force or violence is not present, then the insured cannot claim compensation against theft from the insurance company.”
According  to  the counsel for the Appellant, forcible  and violent entry is not necessary for making a valid claim  under  the  policy.
The claim of the Appellant was repudiated by the insurance company on 31.03.1998 on the ground that the alleged loss did  not come within the purview of the insurance policy.
The PSU’s appeal has been dismissed by the Hon’ble Supreme Court.

The government on Tuesday announced rules regarding MRP or maximum retail price for goods under the GST (goods and services tax) regime that was rolled out at the midnight of Friday and Saturday. There has been ample confusion among both consumers and retailers regarding how the MRP changes will reflect under GST.
“Under the GST regime, if a price of a product has increased the manufacturer/ importer/ packer will have to give an advertisement in two newspapers about the new MRP and put a revised sticker on the packaging,”, Department of Consumer Affairs Secretary Avinash Srivastava said. MUMBAI: The government and banks have scotched rumours that payments by credit cards or other electronic modes of payment would lead to double taxation under the newly-launched Goods and Services Tax.
Revenue secretary Hasmukh Adhia clarified by way of a tweet that “A wrong message is doing rounds on social media that if you make payment of utility bills by credit cards, you will be paying GST twice. This is completely untrue. Please do not recirculate such message without checking it with authority,” he said. …

NEW DELHI: A Hindu married couple may not need to wait six months for a separation order in the case of mutual consent and the marriage can be legally terminated in just a week as the Supreme Court on Tuesday held that the “cooling off” period in not mandatory and can be waived off.
The court ruled that the stipulation under the Hindu Marriage Act for a six-month wait could be done away with if all efforts for mediation and conciliation intended to reunite the parties had failed. The waiving off can be considered if the parties had already lived separately for at least a year. In such situations, the court could take a view that delay in proceedings will only prolong subsequent resettlement. …

STOCKHOLM: US economist Richard Thaler won the 2017 Nobel Economics Prize for his contributions in the field of behavioural economics, the Royal Swedish Academy of Sciences said on Monday.
“In total, Richard Thaler’s contributions have built a bridge between the economic and psychological analyses of individual decision-making,” the award-giving body said on announcing the 9 million Swedish crown ($1.1 million) prize. …

Kazuo Ishiguro, the British author of “Remains of the Day”, has won the Nobel Prize for Literature, the Swedish Academy announced on Thursday. Japan-born Ishiguro won the Man Booker Prize for the 1989 novel that was made into an Oscar-nominated movie. The Swedish Academy hailed his ability to reveal “the abyss beneath our illusory sense of connection with the world”. The award of the 9 million crown ($1.1 million) prize marks a return to a more mainstream interpretation of literature after it went to American singer-songwriter Bob Dylan last year. The works of Ishiguro, who moved to Britain as a young child, often touch on memory, time and self-delusion, the Academy said. “He is a little bit like a mix of Jane Austen, comedy of manners and Franz Kafka. If you mix this a little, not too much, you get Ishiguro in a nutshell,” said Sara Danius, permanent secretary of the Swedish Academy. …

New Delhi : It could be a precedent for India that how to handle bank defaulters and debtors, the Supreme People’s Court of China passed a stern order restricting them travelling by plane, applying for loans and credit cards. The court has also blacklisted 6.73 million bank defaulters.
As per report of Global Times, the Chinese government had launched a massive crackdown on defaulters and had barred 6.15 million people from buying plane tickets and 2.22 million from travelling by high-speed train. …

There is an entire, submerged and unrecognised continent that has been hiding until now, according to scientists. New Zealand is sitting on top of the geological entity, most of which sits underneath the South Pacific and so can’t be seen, according to a major new paper.
In a paper published in the Geological Society of America’s Journal, researchers explain that Zealandia measures five million sq km which is about two thirds of neighbouring Australia.
