वेश्यावृति और वेश्याओं की स्तिथि पर बन रही एक डाक्यूमेंट्री फिल्म के सिलसिले में मुझे हाल ही में एक बड़े शहर के रेड लाइट एरिया में जाने का मौका मिला| जैसा कि अमूमन होता है कि हम ऐसी औरतों को या तो नफरत की नजर से देखते हैं या फिर बेचारगी के तराजू से तौलते हैं| यहाँ भी शुरू में हालात कुछ ऐसे ही थे| ज्यादातर औरतें अपने हालात और इस धंधे में होने वाली तमाम मुश्किलों के बारे में बयान कर रहीं थीं | हम सब जानते ही हैं कि जब से एस्कॉर्ट और हाई प्रोफाइल कॉल गर्ल्स ने इस काम को अपनाया है तबसे पारंपरिक कोठेवालियों के बुरे दिन शुरू हो गए हैं| हालांकि ये भी अपनी ताज़ा नस्लों को पारंपरिक शैली से बाहर निकाल कर डिजिटल दुनिया के लिए तैयार कर रही हैं लेकिन फिर भी दिक्कतें तो हैं ही|क्योंकि ना तो इनके पास उतनी सुविधाएं हैं और ना ही पैसा, तो किसी भी हाल में अपनी जड़ों से जुड़े रहना इनकी एक मजबूरी है|
कई औरतों से बात करने के बाद मेरी मुलाकात एक २५-२६ साल की लड़की से हुई | वो अपनी एक छोटी सी कोठरी के बाहर तैयार होकर बैठी थी | हमने उससे बात करना शुरू किया | उसने बड़े ही चहकते हुए अंदाज में अपना नाम बताया और हमसे भी दो चार सवाल पूछ डाले, मसलन ये क्या कर रहे हो, क्यों कर रहे हो वगैरह वगैरह | ऐसा लगता था कि वो खुश थी वहाँ, हाँ, सही सुना आपने, वो खुश थी | पर ऐसी नर्क जैसी जगह पर कोई कैसे खुश हो सकता है लेकिन उसने हमारी सोच को झुठला दिया | उसके बारे में मेरी दिलचस्पी और बढ़ गयी | मैं उसकी कहानी जानना चाहती थी | उसने भी बिना हिचके बताना शुरू किया | “मैं उत्तर भारत के एक छोटे से कस्बे से हूँ, मेरे गावं में हमारे एक पड़ोसी थे | उनकी बेटी मेरी अच्छी सहेली थी | हम दोनों बहुत समय साथ में रहते थे | एक बार उनके यहाँ उनके एक रिश्तेदार आये जिनके लड़के से मेरे को प्यार हो गया | हम दोनों के परिवार वाले तो मानने वाले नहीं थे इसलिए वो मेरे को लेकर भाग आया | यहाँ उसके पहचान वाले कुछ लोग थे | उधर हम लोग कुछ दिन रहे | उसने और मैंने काम तलाश करने की कोशिश की लेकिन बात नहीं बनी | कुछ दिन में जो घर से पैसे वगैरह लाये थे वो सब ख़त्म हो गए| तब मुश्किल होने लगी | हम दोनों में झगड़े भी होने लगे और मेरा बॉयफ्रेंड मेरे को मारने भी लगा | उसके इधर जो जानने वाले लोग थे उन्होंने उसको इस धंधे के बारे में सुझाव दिया और बोला कि अगर मैं मान जाऊं तो वो ग्राहक पटा कर लाएंगे लेकिन बदले में उनको भी कमीशन चाहिएगा | मेरा बॉयफ्रेंड ने मेरे को बहुत समझाया और कहा कि इसके अलावा हमारे पास कोई रास्ता नहीं है वरना हमें सुसाइड करना पड़ेगा या फिर घर वापस जाना होगा | उसने कहा कि उसे मेरे ऐसा करने से कोई प्रॉब्लम भी नहीं है वो हमेशा मेरा साथ निभाएगा अगर मैं इस मुश्किल से उसको बाहर निकालती हु तो| तो मैंने बहुत सोचा और मेरे को लगा कि ये भी मेरे साथ है तो क्या प्रॉब्लम है | फिर मैं घर वापस जा नहीं सकती थी और मरना मुझे मंजूर नहीं था| जीने के लिए घर से भागी थी अब मर क्यों जाऊं, तो मैंने मन बना लिया कि ठीक है यही सही| ऐसे ही जियेंगे | मेरे बॉयफ्रैंड और उसके दोस्तों ने मेरे लिए कस्मटर लाना शुरू कर दिया| हर रोज एक कस्टमर लाया जाता और उस एक दिन का खर्च निकल जाता | ऐसे कुछ दिन चला लेकिन कुछ पैसा जुड़ नहीं पा रहा था क्योंकि रोज का खाना, पीना और कमीशन वगैरह का पैसा निकालकर कुछ बचता ही नहीं था | तब मेरा बॉयफ्रेंड मेरे पास एक नया ऑफर लेकर आया कि वो मुझे एक कोठे पर बेचेगा और वहां से बदले में एक मोटी रकम लेकर उससे अपना काम शुरू करेगा | फिर कुछ दिन में वापस मुझे वहां से खरीदकर ले जाएगा | मैंने ये बात भी मान ली | वो मुझे यहाँ छोड़कर पैसे लेकर चला गया | तब से मैं यहाँ हूँ | कुछ दिन तक वो कभी कभी मिलने आता था | फिर उसने आना बंद कर दिया | फिर एक दिन उसका एक दोस्त यहाँ आया और बताया कि अभी वो दूसरी लड़की के साथ सेट हो गया है और तेरे को भूल गया है | तो अभी तू इधर ही रहने वाली है |
पहले तो मेरे को दुःख हुआ, मैं बहुत रोई धोयी लेकिन इधर कोई किसी के आंसू नहीं पोंछता क्योंकि सब ही तो रोते हैं यहाँ | बहुत दिन सदमे में रहने के बाद मैंने फिर सोचा कि दुखी होकर क्या करूँगी | अपने को जिन्दा रखना है तो अब यही मेरी किस्मत सही, कोई क्या कर सकता है | सब समझदार लोग बोलते हैं की सब भगवान् की मर्जी से होता है तो मैं उसकी मर्जी के खिलाफ कैसे जा सकती हूँ | फिर मैंने सोचा, भगवान् सबके बारे में तय करता है तो शायद उसने मुझे इधर ख़ुशी बांटने के लिए भेजा है | तो मैं इधर लोगों को खुशियां बांटने का काम करती हूँ | मेरे कस्टमर लोग आते हैं इधर दुखी होकर और मेरे साथ टाइम बिताकर खुश होकर जाते हैं | दुनिया बोलती है धंधा करती है, हाँ तो करती हूँ धंधा लेकिन ख़ुशी बांटने का धंधा जो हर किसी के बस की बात नहीं है | दुखी तो हम किसी को भी कर सकते हैं, लेकिन खुश करना आसान नहीं होता और मेरे को तो उस ऊपर वाले ने इस काम के लिए चुना है तो मै जो कर रही हूँ, उसमें खुश हूँ और दूसरों को भी खुश करती हूँ |”

SC: Details Of Marks In Civil Services (Prelims) Examination Cannot Be Disclosed Mechanically Under RTI
Feb 22, 2018 : Dtf.in NEW DELHI: The Supreme Court has held that raw and scaled marks awarded to candidates in Civil Services (Prelims) examination cannot be disclosed under the Right to Information Act, 2005, and has set aside the Delhi High Court’s order. The respondents-writ petitioners were unsuccessful candidates in the Civil Services (Preliminary) Examination, 2010. They approached the High Court for a direction to the Union Public Service Commission (UPSC) to disclose the details of marks (raw and scaled) awarded to them in the Civil Services (Prelims) Examination 2010. The information in the form of cut-off marks for every subject, scaling methodology, model answers and complete result of all candidates were also sought. Learned Single Judge directed that the information sought be provided within fifteen days. The said view of the Single Judge was affirmed by the Division Bench of the High Court. Hon’ble Supreme Court has ruled as under:- “Weighing the need for transparency and accountability on the one hand and requirement of optimum use of fiscal resources and confidentiality of sensitive information on the other, we are of the view that information sought with regard to marks in Civil Services Exam cannot be directed to be furnished mechanically. Situation of exams of other academic bodies may stand on different footing. File Notings By Junior Officers For Use By His Superiors Not Third Party Information Under RTI Act: Delhi HC
Feb 21, 2018 : Dtf.in Hon’ble Delhi High Court has recently ruled that Section 8 of the Act provides for exemption from disclosure of certain information and none of the provisions of Section 8 provides for blanket exemption that entitles the respondent to withhold all notings on a file. The petitioner had challenged the order dated 04.09.2013 passed by the Central Information Commission. Briefly stated, the petitioner had filed an application dated 06.11.2010 under the Right to Information Act, 2005 seeking certain information including the certified copy of a report sent by the then Governor of Karnataka to the Union Home Ministry relating to the political situation in the State of Karanataka and for imposing President’s Rule in that State. The petitioner had also sought information as to what action had been taken by the Government of India on the said report and also the file notings in respect of the said report. The said information was declined to the petitioner. The petitioner filed an appeal before the the First Appellate Authority (FAA) under Section 19 (1) of the Act, but was not successful. Aggrieved by the order passed by the FAA, the petitioner preferred a second appeal under section 19(3) of the Act, which was stated to be pending consideration before the CIC. In the meantime, the petitioner filed another application dated 07.06.2012 under the Act, inter alia, seeking the information, including complete details of file notings made on the above said file number as on date, list of the officers with their designation to whom before the said file is placed. Also provide me the noting made by them on the said file, etc. It has, inter alia, been ruled by Hon’ble High Court as under:- “8. ….. the file concerning the petitioner‟s application cannot, obviously, be considered confidential/secret. Admittedly, this is also not the case of the respondents; they do not claim that the notings on the file relating to the petitioner‟s application dated 06.11.2010 have been classified as secret or confidential. 9. In view of the above, the impugned order, inasmuch as it holds that the information sought for by the petitioner is exempt from disclosure under Section 8(1)(e) of the Act, cannot be sustained. 10 The contention that notings made by a junior officer for use by his superiors is third party information, which requires compliance of section 11 of the Act, is unmerited. Any noting made in the official records of the Government/public authority is information belonging to the concerned Government/public authority. The question whether the information relates to a third party is to be determined by the nature of the information and not its source. The Government is not a natural person and all information contained in the official records of the Government/public authority is generated by individuals (whether employed with the Government or not) or other entities. Thus, the reasoning, that the notings or information generated by an employee during the course of his employment is his information and thus has to be treated as relating to a third party, is flawed. 11. Section 8 of the Act provides for exemption from disclosure of certain information and none of the provisions of Section 8 provide for blanket exemption that entitles the respondent to withhold all notings on a file.” The impugned order has been set aside by Hon’ble Delhi High Court. The matter has been remanded to the CIC to consider afresh. The CIC has been requested to pass a final order as expeditiously as possible and preferably within a period of three months from the date of the order. Dec 11, 2017 : Dtf.in A perusal of the CIC’s Interim shows that the appellant had alleged that the CPIO was causing delay in resolving his seniority issue which has resulted in reduction of his salary by Rs. 17,000 (approximately). The Commission found that the appellant has a genuine case, as giving illegible documents amounts to denial of information. Accordingly, the CPIO was, inter alia, directed to explain why the Public Authority should not be directed to pay compensation to the appellant for providing illegible documents, within 15 days from the date of the order. Further, the Public Authority has been directed to return the amount of Rs. 176 deposited by the appellant. CPIO provided point-wise information 25.02.2015. FAA vide his order stated that information on record be supplied within the stipulated period. Being dissatisfied by the response received, the appellant approached this Commission. MEDICAL REIMBURSEMENT CLAIMS OF PENSIONERS: The Supreme Court has decided that in the facts and circumstances of the case, they are of opinion that the treatment of the petitioner in non-empanelled hospital was genuine because there was no option left with him at the relevant time. The respondent-State has been directed to pay the balance amount of Rs.4,99,555/- to the writ petitioner. They have also made it clear that the said decision is confined to this case only. Further, Hon’ble Supreme Court has also directed the concerned Ministry to device a Committee for grievance redressal of the retired pensioners consisting of Special Directorate General, Directorate General, 2 (two) Additional Directors and 1 (one) Specialist in the field which shall ensure timely and hassle free disposal of the claims within a period of 7 (seven) days. The payment of arrears of Dearness Allowance will not be made before the date of disbursement of salary of March, 2018. These orders shall also apply to the civilian employees paid from the Defence Services Estimates and the expenditure will be chargeable to the relevant head of the Defence Services Estimates. In respect of Armed Forces personnel and Railway employees, separate orders will be issued by the Ministry of Defence and Ministry of Railways, respectively. According to an order issued by the Department of Personnel and Training, the allowance has been more than doubled to Rs 4,500 from the existing Rs 2,000 per month, in case of deputation within the same station. This move is based on the recommendation of the 7th central pay commission. “In case of deputation within the same station, the allowance will be payable at the rate of 5% of basic pay subject to a maximum of Rs 4,500 per month,” said a statement from the ministry. The order, issued last Friday, also mentioned that deputation allowance will be payable at the rate of 10% of basic pay, subject to a maximum of Rs 9,000 per month, for deputations in another station. Previously, the celling for deputation in a different city was Rs 4,000. “The ceilings will further rise by 25% each time dearness allowance is increased by 50 per cent,” it added. …
House Building Advance Rules (HBA) Rules, 2017: Advance hiked to Rs.25 lakhs
Nov 12, 2017 : Dtf.in New Delhi. The Government has revised the House Building Advance (HBA) rules for Central Government Employees incorporating the accepted recommendations of the 7th Pay Commission. Following are the salient features of the new rules:-
The total amount of advance that a central government employee can borrow from government has been revised upwards. The employee can up to borrow 34 months of the basic pay subject to a maximum of Rs. 25 lakhs (Rs. Twenty Five Lakhs only), or cost of the house/flat, or the amount according to repaying capacity, whichever is the least for new construction/purchase of new house/flat. Earlier this limit was only Rs.7.50 lakhs.
Similarly, the HBA amount for expansion of the house has been revised to a maximum of Rs.10 lakhs or 34 months of basic pay or cost of the expansion of the house or amount according to repaying capacity, whichever is least. This amount was earlier Rs.1.80 lakhs.
The cost ceiling limit of the house which an employee can construct/purchase has been revised to Rs.1.00 crore with a proviso of upward revision of 25% in deserving cases. The earlier cost ceiling limit was Rs.30 lakhs.
Both spouses, if they are central government employees, are now eligible to take HBA either jointly, or separately. Earlier only one spouse was eligible for House Building Advance.
There is a provision for individuals migrating from home loans taken from Financial Institutions/ Banks to HBA, if they so desire.
The provision for availing ‘second charge’ on the house for taking loans to fund balance amount from Banks/ Financial Institutions has been simplified considerably. ‘No Objection Certificate’ will be issued along with sanction order of HBA, on employee’s declaration.
Henceforth, the rate of Interest on Housing Building Advance shall be at only one rate of 8.50% at simple interest (in place of the earlier four slabs of bearing interest rates ranging from 6% to 9.50% for different slabs of HBA which ranged from Rs.50,000/- to Rs.7,50,000/-) .
This rate of interest shall be reviewed every three years. All cases of subsequent tranches/ installments of HBA being taken by the employee in different financial years shall be governed by the applicable rate of interest in the year in which the HBA was sanctioned, in the event of change in the rate of interest. HBA is admissible to an employee only once in a life time.
The clause of adding a higher rate of interest at 2.5% (two point five percent) above the prescribed rate during sanction of House Building Advance stands withdrawn. Earlier the employee was sanctioned an advance at an interest rate of 2.5% above the scheduled rates with the stipulation that if conditions attached to the sanction including those relating to the recovery of amount are fulfilled completely, to the satisfaction of the competent authority, a rebate of interest to the extent of 2.5% was allowed.
The methodology of recovery of HBA shall continue as per the existing pattern recovery of principal first in the first fifteen years in 180 monthly instalments and interest thereafter in next five years in 60 monthly instalments.
The house/flat constructed/purchased with the help of House Building advance can be insured with the private insurance companies which are approved by Insurance Regulatory Development Authority (IRDA).
This attractive package is expected to incentivize the government employee to buy house/ flat by taking the revised HBA along with other bank loans, if required. This will give a fillip to the Housing infrastructure sector.(Source: pib website)

7th Pay Commission: Pay revision of employees following CDA pattern in Central Public Sector Enterprises (CPSEs)
Aug 21, 2017 Consequent to the issue of the Notification dated 25.07.2016 by the Department of Expenditure on the revision of pay scales of the Central Government employees w.e.f. 01.01.2006, the Department of Public Enterprises has decided that the pay scales in respect of the Public Sector employees following the CDA pattern of pay in 69 Public Sector Enterprises would also be revised w.e.f. 01.01.2006. Accordingly, the pay scales of the employees of CPSEs following the CDA pattern will be revised as per the Notification dated 25.07.2006 and the rates of Dearness Allowance would be as per the DoE O.Ms. dated 04.11.2006 and 30.03.2007. The revised rates of a number of allowances have also been made applicable as per the respective O.Ms. of Department of Expenditure with effect from 01.07.2017. Any subsequent amendments made by the Department of Expenditure in respect of those allowances for Central Government employees would be automatically applicable to these employees also. Further, as per the DPE O.M. dated 07.08.2017, the benefit of pay revision may be allowed only to employees of those CPSEs that are not loss making and are in a position to absorb the additional expenditure on account of pay revision from their own resources without any budgetary support from the Government. The Board of Directors would consider the proposal of pay revision of all employees of CPSEs, keeping in mind the affordability and capacity of the CPSE to pay. Thereafter, they will submit a proposal to their Administrative Ministry / Departments, which will approve the proposal with the concurrence of its Financial Advisor.

Under the Priority Programme Pradhan Mantri Krishi Sinchayee Yojana, Siaha district of Mizoram was awarded in North East and Hill states category and Banaskantha district of Gujarat was awarded under the category of other states. Under the Priority Programme Pradhan Mantri Fasal Bima Yojana, the awards were given to Gomati district of Tripura in North East and Hill states category and Jalna district of Maharashtra under the category of other states. Under the Priority Programme e-National Agriculture Market (e-NAM), Solan district of Himachal Pradesh was awarded in North East and Hill states category and Nizamabad district of Telangana was awarded under the category of other states. Under the Priority Programme Deendayal Upadhyaya Gram Jyoti Yojana, the awards were given to Sivasagar district of Assam in North East and Hill states category and Nalanda district of Bihar under the category of other states. For Start-Up India, the award was given to Gujarat state under other states category and for Stand-Up India, the award was given to North and Middle Andaman of Andaman & Nicobar islands under Union Territories category. The Prime Minister also released two books “New Beginning” on Innovations for the Prime Minister’s Award for Excellence and “Fostering Excellence” for initiatives under identified Priority Programmes. During the function, “Making New India-2017”, a film by DARPG was also screened. Addressing the Civil Servants on the occasion, the Prime Minister described this day as one of “rededication,” and said that civil servants are well aware of their strengths and capabilities, challenges and responsibilities. He said conditions prevailing today are quite different from about two decades ago, and would evolve much further over the next few years. Elaborating on this, the Prime Minister said that earlier, Government was almost the sole provider of goods and services, which left a lot of scope for ignoring one’s shortcomings. However, now, very often, people perceive that the private sector offers better services than Government. The Prime Minister said that with alternatives now being available in several areas, the responsibilities of Government officers have increased. He added that this increase is not in terms of scope of work, but in terms of the challenge. The Prime Minister emphasized the importance of competition, which brings qualitative change. He said that the sooner the attitude of Government can change from regulator to enabler, the faster this challenge of competition will become an opportunity. The Prime Minister said that while the absence of Government in a sphere of activity should be perceptible, its presence in a sphere of activity should not become a burden. He asked civil servants to strive towards such arrangements. Noting the quantum jump in the applications for Civil Service Day awards, from less than 100 last year to over 500 this year, the Prime Minister said that the focus should now be on improving quality, and making excellence a habit. The Prime Minister urged senior officers to ensure that experience does not become a burden that stifles innovation of younger officers. Shri Narendra Modi said that anonymity is one of the greatest strengths of the civil services. He cautioned officers that the use of social media should not lead to a decline in this strength, even as social media and mobile governance are leveraged for connecting people to benefits and government schemes. Speaking in the context of “reform, perform and transform”, the Prime Minister said that political will is needed for reform, but the “perform” part of this formulation must come from civil servants, while transformation is enabled by people’s participation. The Prime Minister said that civil servants must ensure that every decision is taken keeping national interest in mind, and this should be their touchstone for taking a decision. Recalling that the year 2022 would mark 75 years of independence, he urged civil servants to play the role of catalytic agents in fulfilling the dreams of freedom fighters. The Minister of State for Development of North Eastern Region (I/C), Prime Minister’s Office, Personnel, Public Grievances & Pensions, Atomic Energy and Space, Dr. Jitendra Singh said that under the leadership of Prime Minister Shri Narendra Modi, the celebration of Civil Services Day has undergone a considerable change during the last three years and has now emerged as an effective platform for mutual exchange of best practices. He said that this year, 599 districts participated in the PM Awards competition, as compared to 74 districts last year. He said that this shows the trend towards competitive federalism and now more and more districts are competing for these awards by improving their performance in various Priority Programmes. The Department of Administrative Reforms and Public Grievances made an elaborate exercise through a platform for young officers and 615 IAS officers of four batches (2013-2016) spent about 2000 hours and provided their inputs on this platform, he added. The Minister said that this year’s theme of CSD is ‘Making New India’, which is on the lines of the Prime Minister’s vision of New India. Without good Civil Servants, we can never achieve good governance, he added. He also emphasised on the Maximum Governance and Minimum Government. Earlier, the Cabinet Secretary, Shri P.K. Sinha in his welcome address highlighted the entire process involved in the selection of awardees through different committees for initiatives under the various Priority Programmes. The Department organised workshops at different places for replication of identified good governance initiatives of the Government, he added. New Delhi, March 08, 2017 : Dtf.in After a review the General Provident Fund Rules have been liberalized by the Government of India. It has been decided by the Government to permit withdrawals from the fund by the subscriber for the following purposes: (i) Education – This will include primary, secondary and higher education, covering all streams and institutions, (ii) Obligatory Expenses, viz. betrothal, marriage, funerals, or other ceremonies of self or family members and dependants, (iii) Illness of self, family members or dependants, (iv) Purchase of consumer durables. It has been decided by the Government to permit withdrawal of up to twelve months’ pay or three-fourth of the amount standing at credit, whichever is less. For illness, the withdrawal may be allowed up to 90% of the amount standing at credit of the subscriber. A subscriber may seek withdrawal after completion of ten years of service. (v) Housing including building or acquiring a suitable-house or a ready-built flat for his residence, (vi) Repayment of outstanding housing loan, (vii) Purchase of house site for building a house, (viii) Constructing a house on a site acquired, (lx) Reconstructing or making additions on a house already acquired, (x) Renovating, additions or alterations of ancestral house. A subscriber may be allowed to withdraw up to ninety percent of the amount standing at credit for the above purposes. It is also decided do away with the present instructions which lay down that subsequent to the sale of house for which GPF withdrawal has been availed, the amount. withdrawn has to be deposited back. GPF withdrawal for housing purpose will no longer be linked with the limits prescribed under HBA rules. A subscriber may be permitted to avail the facility at any time during his service. (xi) Purchase of motor car/motor cycle/ scooter, etc., or repayment of loan already taken for the purpose, (xii) Extensive repairs /overhauling of motor car, (xiii) Making deposit to book a motor car/motor cycle/scoter, moped, etc. Further, a subscriber may be permitted to withdraw three-fourth of the amount standing at credit or cost of the vehicle, whichever is less for the above purposes. Withdrawal for the above purpose will be permitted after completion of 10 years of service. Presently, withdrawal of up to 90% of balance without assigning reasons is allowed for Government servants who are due for retirement on superannuation within a year. It is proposed that this may be allowed for up to two years before superannuation. In all cases of withdrawal from the fund by the subscriber, the declared Head of Department is competent to sanction withdrawal. No documentary proof will be required to be furnished by the subscriber. A simple declaration form by the subscriber explaining the reasons for withdrawal would be sufficient. As per the GPF(CS) Rule 1960, no time limit has been prescribed for sanction and payment of withdrawal amount. Therefore, it has been decided by the Government to prescribe a maximum time limit of fifteen days for sanction and payment of withdrawal from the Fund. In case of emergencies like illness etc., the time limit may be restricted to seven days. Feb 22, 2018 : Dtf.in NEW DELHI: The Supreme Court has held that raw and scaled marks awarded to candidates in Civil Services (Prelims) examination cannot be disclosed under the Right to Information Act, 2005, and has set aside the Delhi High Court’s order. The respondents-writ petitioners were unsuccessful candidates in the Civil Services (Preliminary) Examination, 2010. They approached the High Court for a direction to the Union Public Service Commission (UPSC) to disclose the details of marks (raw and scaled) awarded to them in the Civil Services (Prelims) Examination 2010. The information in the form of cut-off marks for every subject, scaling methodology, model answers and complete result of all candidates were also sought. Learned Single Judge directed that the information sought be provided within fifteen days. The said view of the Single Judge was affirmed by the Division Bench of the High Court. Hon’ble Supreme Court has ruled as under:- “Weighing the need for transparency and accountability on the one hand and requirement of optimum use of fiscal resources and confidentiality of sensitive information on the other, we are of the view that information sought with regard to marks in Civil Services Exam cannot be directed to be furnished mechanically. Situation of exams of other academic bodies may stand on different footing. File Notings By Junior Officers For Use By His Superiors Not Third Party Information Under RTI Act: Delhi HC
Feb 21, 2018 : Dtf.in Hon’ble Delhi High Court has recently ruled that Section 8 of the Act provides for exemption from disclosure of certain information and none of the provisions of Section 8 provides for blanket exemption that entitles the respondent to withhold all notings on a file. The petitioner had challenged the order dated 04.09.2013 passed by the Central Information Commission. Briefly stated, the petitioner had filed an application dated 06.11.2010 under the Right to Information Act, 2005 seeking certain information including the certified copy of a report sent by the then Governor of Karnataka to the Union Home Ministry relating to the political situation in the State of Karanataka and for imposing President’s Rule in that State. The petitioner had also sought information as to what action had been taken by the Government of India on the said report and also the file notings in respect of the said report. The said information was declined to the petitioner. The petitioner filed an appeal before the the First Appellate Authority (FAA) under Section 19 (1) of the Act, but was not successful. Aggrieved by the order passed by the FAA, the petitioner preferred a second appeal under section 19(3) of the Act, which was stated to be pending consideration before the CIC. In the meantime, the petitioner filed another application dated 07.06.2012 under the Act, inter alia, seeking the information, including complete details of file notings made on the above said file number as on date, list of the officers with their designation to whom before the said file is placed. Also provide me the noting made by them on the said file, etc. It has, inter alia, been ruled by Hon’ble High Court as under:- “8. ….. the file concerning the petitioner‟s application cannot, obviously, be considered confidential/secret. Admittedly, this is also not the case of the respondents; they do not claim that the notings on the file relating to the petitioner‟s application dated 06.11.2010 have been classified as secret or confidential. 9. In view of the above, the impugned order, inasmuch as it holds that the information sought for by the petitioner is exempt from disclosure under Section 8(1)(e) of the Act, cannot be sustained. 10 The contention that notings made by a junior officer for use by his superiors is third party information, which requires compliance of section 11 of the Act, is unmerited. Any noting made in the official records of the Government/public authority is information belonging to the concerned Government/public authority. The question whether the information relates to a third party is to be determined by the nature of the information and not its source. The Government is not a natural person and all information contained in the official records of the Government/public authority is generated by individuals (whether employed with the Government or not) or other entities. Thus, the reasoning, that the notings or information generated by an employee during the course of his employment is his information and thus has to be treated as relating to a third party, is flawed. 11. Section 8 of the Act provides for exemption from disclosure of certain information and none of the provisions of Section 8 provide for blanket exemption that entitles the respondent to withhold all notings on a file.” The impugned order has been set aside by Hon’ble Delhi High Court. The matter has been remanded to the CIC to consider afresh. The CIC has been requested to pass a final order as expeditiously as possible and preferably within a period of three months from the date of the order. Dec 11, 2017 : Dtf.in A perusal of the CIC’s Interim shows that the appellant had alleged that the CPIO was causing delay in resolving his seniority issue which has resulted in reduction of his salary by Rs. 17,000 (approximately). The Commission found that the appellant has a genuine case, as giving illegible documents amounts to denial of information. Accordingly, the CPIO was, inter alia, directed to explain why the Public Authority should not be directed to pay compensation to the appellant for providing illegible documents, within 15 days from the date of the order. Further, the Public Authority has been directed to return the amount of Rs. 176 deposited by the appellant. Sep 16, 2017 : Dtf.in Information regarding the number of outsider postmen at Jalgaon HO and since when they had been discharging their duties along with their names and other particulars, was sought by an information seeker under the Right to Information Act, 2005. CPIO provided point-wise information 25.02.2015. FAA vide his order stated that information on record be supplied within the stipulated period. Being dissatisfied by the response received, the appellant approached this Commission. The CIC on May 29, 2017 ordered, inter alia, as under:- “It is wrong to collect huge amount after delaying the response by two months. As per law they cannot charge if they have delayed the response beyond one month.
