“वो मुझसे अपनी खुशियाँ लेने आते हैं, मेरे साथ हमबिस्तर होना तो उसका बस एक जरिया है, मैं किसी को खुशियाँ बांटने का काम करती हूँ, अब आप उसे किसी भी नाम से पुकारो मेरे को कोई फर्क नहीं पड़ता”| ये शब्द हैं एक पेशेवर वेश्या के, एक धंधेवाली के, जी हाँ, हम सब अक्सर जिस्मफरोशी करने वाली औरतों को इसी नाम से पुकारते है, जानते है| लेकिन एक ऐसी ही धंधेवाली ने बड़ी ही बेबाकी से मुझे अपने काम के बारे में बताया और ना सिर्फ बताया बल्कि अपने काम को एक नए अंदाज में उसने मेरे सामने पेश किया जहाँ अपने काम के लिए अगर उसको फक्र नहीं था तो कोई गिला भी नहीं था| बल्कि बड़ी सहजता से उसने अपने आप को लोगों को खुशियाँ बांटने वाला एक जरिया बताया |
वेश्यावृति और वेश्याओं की स्तिथि पर बन रही एक डाक्यूमेंट्री फिल्म के सिलसिले में मुझे हाल ही में एक बड़े शहर के रेड लाइट एरिया में जाने का मौका मिला| जैसा कि अमूमन होता है कि हम ऐसी औरतों को या तो नफरत की नजर से देखते हैं या फिर बेचारगी के तराजू से तौलते हैं| यहाँ भी शुरू में हालात कुछ ऐसे ही थे| ज्यादातर औरतें अपने हालात और इस धंधे में होने वाली तमाम मुश्किलों के बारे में बयान कर रहीं थीं | हम सब जानते ही हैं कि जब से एस्कॉर्ट और हाई प्रोफाइल कॉल गर्ल्स ने इस काम को अपनाया है तबसे पारंपरिक कोठेवालियों के बुरे दिन शुरू हो गए हैं| हालांकि ये भी अपनी ताज़ा नस्लों को पारंपरिक शैली से बाहर निकाल कर डिजिटल दुनिया के लिए तैयार कर रही हैं लेकिन फिर भी दिक्कतें तो हैं ही|क्योंकि ना तो इनके पास उतनी सुविधाएं हैं और ना ही पैसा, तो किसी भी हाल में अपनी जड़ों से जुड़े रहना इनकी एक मजबूरी है|
कई औरतों से बात करने के बाद मेरी मुलाकात एक २५-२६ साल की लड़की से हुई | वो अपनी एक छोटी सी कोठरी के बाहर तैयार होकर बैठी थी | हमने उससे बात करना शुरू किया | उसने बड़े ही चहकते हुए अंदाज में अपना नाम बताया और हमसे भी दो चार सवाल पूछ डाले, मसलन ये क्या कर रहे हो, क्यों कर रहे हो वगैरह वगैरह | ऐसा लगता था कि वो खुश थी वहाँ, हाँ, सही सुना आपने, वो खुश थी | पर ऐसी नर्क जैसी जगह पर कोई कैसे खुश हो सकता है लेकिन उसने हमारी सोच को झुठला दिया | उसके बारे में मेरी दिलचस्पी और बढ़ गयी | मैं उसकी कहानी जानना चाहती थी | उसने भी बिना हिचके बताना शुरू किया | “मैं उत्तर भारत के एक छोटे से कस्बे से हूँ, मेरे गावं में हमारे एक पड़ोसी थे | उनकी बेटी मेरी अच्छी सहेली थी | हम दोनों बहुत समय साथ में रहते थे | एक बार उनके यहाँ उनके एक रिश्तेदार आये जिनके लड़के से मेरे को प्यार हो गया | हम दोनों के परिवार वाले तो मानने वाले नहीं थे इसलिए वो मेरे को लेकर भाग आया | यहाँ उसके पहचान वाले कुछ लोग थे | उधर हम लोग कुछ दिन रहे | उसने और मैंने काम तलाश करने की कोशिश की लेकिन बात नहीं बनी | कुछ दिन में जो घर से पैसे वगैरह लाये थे वो सब ख़त्म हो गए| तब मुश्किल होने लगी | हम दोनों में झगड़े भी होने लगे और मेरा बॉयफ्रेंड मेरे को मारने भी लगा | उसके इधर जो जानने वाले लोग थे उन्होंने उसको इस धंधे के बारे में सुझाव दिया और बोला कि अगर मैं मान जाऊं तो वो ग्राहक पटा कर लाएंगे लेकिन बदले में उनको भी कमीशन चाहिएगा | मेरा बॉयफ्रेंड ने मेरे को बहुत समझाया और कहा कि इसके अलावा हमारे पास कोई रास्ता नहीं है वरना हमें सुसाइड करना पड़ेगा या फिर घर वापस जाना होगा | उसने कहा कि उसे मेरे ऐसा करने से कोई प्रॉब्लम भी नहीं है वो हमेशा मेरा साथ निभाएगा अगर मैं इस मुश्किल से उसको बाहर निकालती हु तो| तो मैंने बहुत सोचा और मेरे को लगा कि ये भी मेरे साथ है तो क्या प्रॉब्लम है | फिर मैं घर वापस जा नहीं सकती थी और मरना मुझे मंजूर नहीं था| जीने के लिए घर से भागी थी अब मर क्यों जाऊं, तो मैंने मन बना लिया कि ठीक है यही सही| ऐसे ही जियेंगे | मेरे बॉयफ्रैंड और उसके दोस्तों ने मेरे लिए कस्मटर लाना शुरू कर दिया| हर रोज एक कस्टमर लाया जाता और उस एक दिन का खर्च निकल जाता | ऐसे कुछ दिन चला लेकिन कुछ पैसा जुड़ नहीं पा रहा था क्योंकि रोज का खाना, पीना और कमीशन वगैरह का पैसा निकालकर कुछ बचता ही नहीं था | तब मेरा बॉयफ्रेंड मेरे पास एक नया ऑफर लेकर आया कि वो मुझे एक कोठे पर बेचेगा और वहां से बदले में एक मोटी रकम लेकर उससे अपना काम शुरू करेगा | फिर कुछ दिन में वापस मुझे वहां से खरीदकर ले जाएगा | मैंने ये बात भी मान ली | वो मुझे यहाँ छोड़कर पैसे लेकर चला गया | तब से मैं यहाँ हूँ | कुछ दिन तक वो कभी कभी मिलने आता था | फिर उसने आना बंद कर दिया | फिर एक दिन उसका एक दोस्त यहाँ आया और बताया कि अभी वो दूसरी लड़की के साथ सेट हो गया है और तेरे को भूल गया है | तो अभी तू इधर ही रहने वाली है |
पहले तो मेरे को दुःख हुआ, मैं बहुत रोई धोयी लेकिन इधर कोई किसी के आंसू नहीं पोंछता क्योंकि सब ही तो रोते हैं यहाँ | बहुत दिन सदमे में रहने के बाद मैंने फिर सोचा कि दुखी होकर क्या करूँगी | अपने को जिन्दा रखना है तो अब यही मेरी किस्मत सही, कोई क्या कर सकता है | सब समझदार लोग बोलते हैं की सब भगवान् की मर्जी से होता है तो मैं उसकी मर्जी के खिलाफ कैसे जा सकती हूँ | फिर मैंने सोचा, भगवान् सबके बारे में तय करता है तो शायद उसने मुझे इधर ख़ुशी बांटने के लिए भेजा है | तो मैं इधर लोगों को खुशियां बांटने का काम करती हूँ | मेरे कस्टमर लोग आते हैं इधर दुखी होकर और मेरे साथ टाइम बिताकर खुश होकर जाते हैं | दुनिया बोलती है धंधा करती है, हाँ तो करती हूँ धंधा लेकिन ख़ुशी बांटने का धंधा जो हर किसी के बस की बात नहीं है | दुखी तो हम किसी को भी कर सकते हैं, लेकिन खुश करना आसान नहीं होता और मेरे को तो उस ऊपर वाले ने इस काम के लिए चुना है तो मै जो कर रही हूँ, उसमें खुश हूँ और दूसरों को भी खुश करती हूँ |”

Cabinet approves inclusion/amendments in the Central List of Other Backward Classes notified in respect of 8 States
Nov 30, 2016 “The Union Cabinet chaired by the Prime Minister Shri Narendra Modi has given its approval to notify inclusion/Amendments in the Central List of Other Backward Classes notified in respect of States of Assam, Bihar, Himachal Pradesh, Jharkhand, Maharashtra, Madhya Pradesh, Jammu & Kashmir and Uttarakhand. On the recommendation of the National Commission for Backward Classes (NCBC), a total of 2479 Entries for inclusion, including its synonyms, sub-castes, etc. in the Central List of Other Backward Classes have been notified in 25 States and 6 Union Territories. The last such notification was issued till September, 2016. Meanwhile more advices for inclusion of castes/communities and corrections in the existing list of OBCs for the State of Assam, Bihar, Himachal Pradesh, Jharkhand, Maharashtra, Madhya Pradesh, Jammu & Kashmir and Uttarakhand have been received from NCBC. Accordingly, a total of 28 changes recommended by NCBC in respect of 8 states including Jammu and Kashmir (15 new entries, 09 synonyms/sub-castes and 04 corrections) have been notified. The changes will enable the persons belonging to these castes/ communities to avail the benefits of reservation in Government services and posts as well as in Central Educational Institutions as per the existing policy. They will also become eligible for benefit under the various welfare schemes, scholarships etc. being administered by the Central Government, which are at present available to the persons belonging to the Other Backward Classes. Background The NCBC was set up in pursuance to the Supreme Court judgement in the Indra Sawhney case as per the NCBC Act 1993. Section 9 (“Functions of the Commission”) of the NCBC Act 1993 states as under: (i) The Commission shall examine requests for inclusion of any class of citizens as a backward class in the lists and hear complaints of over-inclusion or under-inclusion of any backward class in such lists and tender such advice to the Central Government as it deems appropriate. Dec 11, 2017 : Dtf.in A perusal of the CIC’s Interim shows that the appellant had alleged that the CPIO was causing delay in resolving his seniority issue which has resulted in reduction of his salary by Rs. 17,000 (approximately). The Commission found that the appellant has a genuine case, as giving illegible documents amounts to denial of information. Accordingly, the CPIO was, inter alia, directed to explain why the Public Authority should not be directed to pay compensation to the appellant for providing illegible documents, within 15 days from the date of the order. Further, the Public Authority has been directed to return the amount of Rs. 176 deposited by the appellant. Nov 08, 2017 : Umesh Sharma, Advocate, Legalhelplineindia (www.legalhelplineindia.com) New Delhi. The CIC has ruled that the court records are part of the public documents, hence the same can also be obtained under the RTI Act. The definition of public records is also dealt in Section 74 of the Indian Evidence Act of 1972, which reads as under: “74. Public documents.—The following documents are public documents : (1) Documents forming the acts, or records of the acts (i) of the sovereign authority, (ii) of official bodies and tribunals, and (iii) of public officers, legislative, judicial and executive, 1[of any part of India or of the Commonwealth], or of a foreign country; 1[of any part of India or of the Commonwealth], or of a foreign country; (2) Public records kept 2[in any State] of private documents.” The CIC appeal was against an order passed by the PIO of district courts wherein the records of the court proceedings were denied to a complainant. CIC has declared him entitled to the records and issued directions to the PIO. There is a process of inspection of the court records and granting the certified copies of the court records and every court has a copying agency where anyone can apply for certified copies of the court records as per the rules and obtain the certified copies of the documents of a particular case file. The rules however mandate the distinction between decided and pending cases. The records of a decided case can be granted to anyone on application but for the pending cases, the records can only be obtained by the party concerned. Besides this the records of the court can be summoned to any other court and presented. Some unanswered questions in this regard still remain determination as to whether the cause list maintained by the courts is a judicial record or a public record? Several statutory, mandatory and administrative registers maintained in the courts are also undefined whether they are judicial records or administrative records. Since the court records contain both judicial as well as administrative records containing the personal information of the litigating parties, a thin line of demarcation is to be drawn before disclosing all the information to any third party and making the said records as public records. In some cases, courts specifically pass gagging orders for keeping the records in sealed covers, in some cases such as crime against women the names of the females or victims is not to be disclosed. There are several unanswered questions still to be delved upon. The right to privacy of an individual also needs to be kept in mind while disclosing personal information. The order passed by CIC will go a long way in establishing transparency. In an era where all the public records should be available online in digital form, this order of CIC is a step forward.

The Department of Personnel and Training, the nodal department enforcing the Act, put up the draft rules on its website last week, seeking feedback from the public by April 15. The idea behind the revamp of the rules is to simplify the process of obtaining information. However, certain changes proposed in the new draft rules have not gone down well with transparency activists, who fear it may end up as a tool to intimidate them and discourage citizens from using the law. …

The Chief Passport Officer has been directed by the Hon’ble CIC, inter alia, to lay down clearly articulated policy, shared with general public, for re-verification of police report. The Hon’ble CIC’s order was passed while deciding the second appeal from an RTI applicant who had applied for issuance of a new passport. The respondent participated in the hearing through counsel in person. The appellant did not participate in the hearing. In the order passed on March 08, 2017, the respondent was directed to provide to the appellant the information in context of his RTI application within 30 days of the said order. The Respondent CPIO was directed to show cause why action should not be taken against them for contravening the provisions of the RTI Act including not giving correct information, within 30 days of the said order. Further, the Chief Passport Officer was “directed to issue directions to all offices for: (i) Invariably giving point-wise replies to RTI application. (ii) Specific deficient documents should be clearly mentioned. (iii) If an adverse police report is received, its copy should be sent to applicant immediately for his comments. (iv) Clearly articulated policy, shared with general public, for re-verification of police report should be laid down.” The time granted for compliance is “within 30 days”.

Cooperative Banks within the purview of the RTI Act: Bombay High Court
March 3, 2017 : Dtf.in It has been held by the Aurangabad bench of the Bombay High Court that co-operative institutions “need to supply” information to any “public authority” established under the Cooperative Societies Act. The petitioners had sought exemption under the RTI Act, 2005. In para 10 of their judgment dated February 13, 2017, in the case of Jalgaon Jillha Urban Cooperative Banks Association Ltd., Jalgaon Vs. State of Maharashtra & Ors., Hon’ble Bombay High Court has decided as under:- “The provisions of the Maharashtra Cooperative Societies Act if read with the definition of information given in section 2(f) of the Act, it can be said that everything which is mentioned in the definition of information needs to be supplied by the cooperative institution to the authority created under the Cooperative Societies Act. The definition of ‘public authority’ given in section 2(h) shows that such public authority can be created by any law made by the State Legislature. It is already observed that the officers like Register and his subordinate officers are appointed under the Cooperative Societies Act and they have the control over the aforesaid things. In view of these circumstances, the observations made by the Apex Court in the paragraphs already quoted can be used safely when the information is sought from the authority like Register or his subordinates under the Cooperative Societies Act. Thus, the reliefs claimed in the present petition cannot be granted as the reliefs can be used directly or indirectly by the cooperative institutions to deny the supply of the information. The circumstances that the other matters were allowed by this court, other Bench of this Court, cannot come in the way of giving present decision by this Court as the decision of the Supreme Court was not there when other matters were decided by this Court. This Court holds that no relief which is claimed in the present petition can be given to the petitioner. The previous interpretation made by this Court is not correct interpretation in view of the law laid down by the Apex Court. In the result, the petition stands dismissed.”

CIC directs Railway Board to amend the rules for copying charges under RTI
Dec 14, 2016 : Dtf.in New Delhi. The Central Information Commission has, on December 5, directed the Railway Board to stop charging Rs 750 per page for photocopying and follow the provisions of the RTI Act and Rules. Under the RTI Act, Rs. two per page has been fixed for photocopying. The appellant did not participate in the hearing. The respondent stated that the appellant was asked to deposit copying fee Rs. 750/- for reservation chart as per Railway Rules but the appellant did not respond to that letter. The appellant filed 2nd appeal before the CIC. Hon’ble CIC, in its order, directed the Railway Board to take steps to amend the rules regarding copying charges suitably to bring them in conformity with the letter and spirit of the RTI Act and Rules.

According to the ruling of the information commission even if university rules don’t permit the distribution of photocopies of answer sheets to students on demand, the rules under the RTI Act supersedes any university rule thereby giving students the right to demand and get photocopies of their answer sheets. …

The Central Information Commission (CIC) has on last Friday held that the teacher and the school also shall be liable to pay compensation to the injured child according to law. As per the order of the Information Commissioner, the denial of information by the Central Public Information Officer (CPIO) was unwarranted. The information was denied by the CPIO on the ground that it was third party information. The applicant submitted that he needed the information so that his daughter could secure custody of children in her marital dispute against husband Yagya Dutt Arya. The Information Commissioner has decided that “Even if Section 8(1)(j) is assumed to be invoked, the school should have considered that imposing corporal punishment on children is against several laws including Juvenile Justice Act, 2000, is a public wrong, its disclosure has relationship with public activity and it will be in public interest, the revelation of which would not cause unwarranted invasion of the privacy of the individual, besides larger public interest is involved in disclosure only.” The Information Commissioner has, inter alia, passed the following order:-
“28. The teacher and the school also shall be liable to pay compensation to the injured child according to law. The Commission directs the KVS, headquarters and regional directors to voluntarily disclose whether they have framed policy as advised by the NCPCR to eliminate the corporal punishment in their schools, details of incidents of corporal punishments and action taken against liable teachers, compensation to be paid and amount of compensation paid to the victims etc, every year, beginning with 2015-16, within three months. The Commission recommends that each school shall publish such a report every year, which shall be the model for other school. It will go a long way in making school a place of pleasant learning free from assaults and humiliations. The KVS also should have a policy of paying some amount as compensation to the victim children and that amount should be deducted from the salary of liable teacher. The public authority is directed to collect details of teachers punished for corporal assaults on children including the case of Mr. Yagya Dutt Arya. The Commission directs the KVS headquarters to circulate copy of this order to all schools and regional offices. Disposed of.”

कई औरतों से बात करने के बाद मेरी मुलाकात एक २५-२६ साल की लड़की से हुई | वो अपनी एक छोटी सी कोठरी के बाहर तैयार होकर बैठी थी | हमने उससे बात करना शुरू किया | उसने बड़े ही चहकते हुए अंदाज में अपना नाम बताया और हमसे भी दो चार सवाल पूछ डाले, मसलन ये क्या कर रहे हो, क्यों कर रहे हो वगैरह वगैरह | ऐसा लगता था कि वो खुश थी वहाँ, हाँ, सही सुना आपने, वो खुश थी | पर ऐसी नर्क जैसी जगह पर कोई कैसे खुश हो सकता है लेकिन उसने हमारी सोच को झुठला दिया | उसके बारे में मेरी दिलचस्पी और बढ़ गयी | मैं उसकी कहानी जानना चाहती थी | उसने भी बिना हिचके बताना शुरू किया | “मैं उत्तर भारत के एक छोटे से कस्बे से हूँ, मेरे गावं में हमारे एक पड़ोसी थे | उनकी बेटी मेरी अच्छी सहेली थी | हम दोनों बहुत समय साथ में रहते थे | एक बार उनके यहाँ उनके एक रिश्तेदार आये जिनके लड़के से मेरे को प्यार हो गया | हम दोनों के परिवार वाले तो मानने वाले नहीं थे इसलिए वो मेरे को लेकर भाग आया | यहाँ उसके पहचान वाले कुछ लोग थे | उधर हम लोग कुछ दिन रहे | उसने और मैंने काम तलाश करने की कोशिश की लेकिन बात नहीं बनी | कुछ दिन में जो घर से पैसे वगैरह लाये थे वो सब ख़त्म हो गए| तब मुश्किल होने लगी | हम दोनों में झगड़े भी होने लगे और मेरा बॉयफ्रेंड मेरे को मारने भी लगा | उसके इधर जो जानने वाले लोग थे उन्होंने उसको इस धंधे के बारे में सुझाव दिया और बोला कि अगर मैं मान जाऊं तो वो ग्राहक पटा कर लाएंगे लेकिन बदले में उनको भी कमीशन चाहिएगा | मेरा बॉयफ्रेंड ने मेरे को बहुत समझाया और कहा कि इसके अलावा हमारे पास कोई रास्ता नहीं है वरना हमें सुसाइड करना पड़ेगा या फिर घर वापस जाना होगा | उसने कहा कि उसे मेरे ऐसा करने से कोई प्रॉब्लम भी नहीं है वो हमेशा मेरा साथ निभाएगा अगर मैं इस मुश्किल से उसको बाहर निकालती हु तो| तो मैंने बहुत सोचा और मेरे को लगा कि ये भी मेरे साथ है तो क्या प्रॉब्लम है | फिर मैं घर वापस जा नहीं सकती थी और मरना मुझे मंजूर नहीं था| जीने के लिए घर से भागी थी अब मर क्यों जाऊं, तो मैंने मन बना लिया कि ठीक है यही सही| ऐसे ही जियेंगे | मेरे बॉयफ्रैंड और उसके दोस्तों ने मेरे लिए कस्मटर लाना शुरू कर दिया| हर रोज एक कस्टमर लाया जाता और उस एक दिन का खर्च निकल जाता | ऐसे कुछ दिन चला लेकिन कुछ पैसा जुड़ नहीं पा रहा था क्योंकि रोज का खाना, पीना और कमीशन वगैरह का पैसा निकालकर कुछ बचता ही नहीं था | तब मेरा बॉयफ्रेंड मेरे पास एक नया ऑफर लेकर आया कि वो मुझे एक कोठे पर बेचेगा और वहां से बदले में एक मोटी रकम लेकर उससे अपना काम शुरू करेगा | फिर कुछ दिन में वापस मुझे वहां से खरीदकर ले जाएगा | मैंने ये बात भी मान ली | वो मुझे यहाँ छोड़कर पैसे लेकर चला गया | तब से मैं यहाँ हूँ | कुछ दिन तक वो कभी कभी मिलने आता था | फिर उसने आना बंद कर दिया | फिर एक दिन उसका एक दोस्त यहाँ आया और बताया कि अभी वो दूसरी लड़की के साथ सेट हो गया है और तेरे को भूल गया है | तो अभी तू इधर ही रहने वाली है |
पहले तो मेरे को दुःख हुआ, मैं बहुत रोई धोयी लेकिन इधर कोई किसी के आंसू नहीं पोंछता क्योंकि सब ही तो रोते हैं यहाँ | बहुत दिन सदमे में रहने के बाद मैंने फिर सोचा कि दुखी होकर क्या करूँगी | अपने को जिन्दा रखना है तो अब यही मेरी किस्मत सही, कोई क्या कर सकता है | सब समझदार लोग बोलते हैं की सब भगवान् की मर्जी से होता है तो मैं उसकी मर्जी के खिलाफ कैसे जा सकती हूँ | फिर मैंने सोचा, भगवान् सबके बारे में तय करता है तो शायद उसने मुझे इधर ख़ुशी बांटने के लिए भेजा है | तो मैं इधर लोगों को खुशियां बांटने का काम करती हूँ | मेरे कस्टमर लोग आते हैं इधर दुखी होकर और मेरे साथ टाइम बिताकर खुश होकर जाते हैं | दुनिया बोलती है धंधा करती है, हाँ तो करती हूँ धंधा लेकिन ख़ुशी बांटने का धंधा जो हर किसी के बस की बात नहीं है | दुखी तो हम किसी को भी कर सकते हैं, लेकिन खुश करना आसान नहीं होता और मेरे को तो उस ऊपर वाले ने इस काम के लिए चुना है तो मै जो कर रही हूँ, उसमें खुश हूँ और दूसरों को भी खुश करती हूँ |”
